Coupon books were mailed out during the week of December 13, 2010 to your official billing address on record with Management.

Parking Policy, Alarm Monitoring, Pool Area Re-Key and 2011 Budget Meeting Date

Re: Parking Policy, Alarm Monitoring, Pool Area Re-Key and 2011 Budget Meeting Date

Dear Residents of the Greens,

Please be advised that the following notice contains information regarding important policy alterations and two notices that you should be aware of:

1. Parking Policy and Enforcement

Due to various infractions occurring on a regular basis in the Community, including overnight on-street parking, unregistered vehicles and persons parking in other Residents’ driveways, effective December 1, 2010 the Association will begin a strict towing policy for vehicles in violation.

Signs have been posted at the entrance of the community with the required retrieval contact information. Towing will be at the vehicle owner’s expense.

The parking policy can be found in Section 8.08 of your Association Declaration Covenants and Restrictions (DCR’s), as well in related sections in the Master HOA DCR’s and the Greens Rules & Regulations booklet and states in sum and substance:

Only private passenger vehicles may be parked overnight in The Greens (and the Boca Country Club). No vehicles can be parked on any roadway between 2:00am-6:00am. Trucks, pickup trucks, commercial vans, boats, campers and recreational vehicles may not be parked within the confines of The Greens (and the Boca Country Club) between 6:00pm and 8:00am. Motorcycles are not permitted in the Boca Country Club unless approved by your HOA and the Master Association. No parking on the grass is permitted at anytime.


2. Alarm Monitoring by the Master Association

As discussed at prior meetings and correspondence:

a. The Master Association will no longer be providing security monitoring as of December 31, 2010.

b. In consideration of high expense to update the current monitoring system to meet current code compliance, the Master Association has voted on an Amendment to the Master Declaration, specifically deleting Article 6.19 that requires each unit

in the community be equipped with a centrally monitored electronic security system.

c. Various private security monitoring companies are available to you should you wish to engage their services for the monitoring of your home at your own expense.


3. Pool Area Re-Key – Saturday December 4, 2010 10:00a-2:00p
(at Greens Pool)

a. As a second phase of the pool area gate security upgrading, new locks will be installed on the pool area gates and bathroom doors.
b. These locks will utilize Medico keys that cannot be duplicated.
c. Each resident will receive one (1) new key, and duplicates can be provided for. Lost or additional keys are available at a cost of $50.00 per key.
d. Homeowners more than ninety (90) days delinquent paying their Association dues or any fees assessed to their account will not be issued a key, pursuant to State statute.
e. The re-key will occur on Saturday, December 4th.
f. Keys will be available at the Pool area between 10 AM and 2 PM on Saturday, December 4th.
g. After that date, keys can then be mailed to Residents that are not able to pick-up their keys. An alternate date for pick-up on property will be announced at a future date if it becomes necessary to do so.
h. Only homeowners may pick-up these keys. Renters must be given these keys by the respective homeowners as it is the homeowners responsibility to ensure the key is not lost and is in the appropriate parties hands.

4. 2011 Budget Meeting – Thursday December 2, 2010 6:00pm

The budget meeting for The Greens will be held on Thursday December 2, 2010 at 6:00pm, at 1800 Corporate Blvd. N.W., Suite 303 Boca Raton. Upon approval by the Board, the adopted FY2011 Budget will be available upon request by contacting Down East Management Associates (manager@demamgt.com) and a copy will be placed on the Association’s weblog.
A draft of the proposed budget will be available on the Association’s weblog (thegreensnewsletter.blogspot.com) beginning on November 24, 2010. Any comments or suggestions related to the proposed budget should be sent to the Board via electronic mail thegreensnewsletter@gmail.com no later than close of business November 29, 2010.
Note that this meeting will be for the purposes of adopting the Association’s 2011 budget only. A general community meeting will be scheduled for a later date.

Alarm Monitoring

Please be advised that your representative to the Master Association will be asked to cast an important vote on the community’s alarm system at a special meeting to be held in August. This vote should be with the guidance of your Association’s Board of Directors because it will involve amendment of Article 6.19 of the Master Declaration that requires each UNIT in the community be equipped with a centrally monitored electronic security system. The amendment to be voted on in August will propose that Article 6.19 be deleted in its entirety.

Here is the situation giving rise to this amendment. Early this year, the Palm Beach County Sheriffs Department advised the Master Association that pursuant to Palm Beach County Code, the Master Association’s security system, which from its inception has been monitored at the gate, would now require an outside backup monitoring system to be in place by year end. Since receiving the notice, the Executive Committee of the Master Association Board has explored all options it has to meeting this requirement. The options included consideration of the feasibility of installing its own backup monitoring system, interviewing and receiving proposals from several outside firms that provide backup monitoring services, and in consideration of the low current usage of the system by residents, eliminating gate monitoring altogether. Only about one third of the residences in the community are currently hooked up to the gate for monitoring.

Each of the backup monitoring options explored would be expensive. If the Master Association were to install its own backup monitoring system, it would have to hire or engage a specially licensed electrician who would be available on a 24/7 basis. It would also have to purchase and install expensive new equipment to do the backup monitoring. Both the existing and new backup systems would have to be continually maintained. The costs related thereto would significantly increase the Master Association’s annual budgets. As a result, the per unit charge each of the individual associations pays to the Master Association would also increase significantly.

With respect to engaging an outside firm to do the backup monitoring; of the several firms contacted, the prices received for providing the service ranged from $5.99 to $10.99 per unit, per month, plus tax. These rates would only be guaranteed for three years, and all 936 residences would be required to be hooked up to community system. Depending on which firm was selected the new annual cost impact on the Master Association’s budget would range from $67,280.00 to $123,440.00 plus tax, per year. Additionally, all these firms would require access to every unit in the community to inspect the alarm system, and if needed, repair or upgrade the unit’s alarm system at the unit owners’ expense. Depending upon what is needed, this could cost unit owners as

much as $250 - $500 or more in additional expenses. It would also preclude any unit owner from making a decision to use another alarm service of their choosing in place of the community system, and make it necessary for the Master and Local Associations to establish a participation enforcement mechanism adding even more cost for this option.

Finally, the elimination of gate monitoring altogether was also considered as it would have no impact on the Master and Local Associations’ annual budgets -- an important consideration in these challenging economic times. It also recognizes that only one third of the units in the community are currently hooked up to the gate for monitoring, and that those unit owners who have chosen not to be hooked up may currently have their own alarm monitoring services, or they may not want any services and have made other provisions for unit monitoring when they are not in residence. Also, elimination of the gate centralized monitoring would not prevent unit owners who wish to engage a security monitoring service from doing so. And, Unit owners would still be able to call gate security if needed, or they could call 911 directly if they need police, fire or ambulance services. The response time would likely be faster with a direct call to 911. Liability of the Master Association for alarm services would also be eliminated as would the ongoing costs for maintenance and repair of the current system.

Landscaping

Dear Greens Residents:

A number of you have contacted us over the past few weeks regarding the condition of our landscaping, one of the most important features of the community. We are as concerned about the condition of the landscaping as you are.

The Association has taken measures to remedy the current condition which includes bringing in a new landscaping company beginning this week.
To that effect, the new contractor, Twin States Marketing will begin its service Monday morning April 26, 2010. This contractor has considerable experience with luxury developments (including St. Andrews, Woodfield Country Club, Polo Club and Mizner's Preserve) and comes highly recommended.

Turf cuts, hedge and bush trimming, mulching, as well as major tree trimming will occur in the coming two weeks. There will likely be quite a few trucks on the property from time to time, so please keep an eye out for our progress. Once the major work is done over the next two weeks, we will address weeds and fertilization with a weed and feed program to remove the weeds from the lawns and fertilize the vegetation. It will take some time to address all of the weed issues, as they have become quite pervasive, but this will be a major focus of the program.

Please note that the decision to replace our longtime landscape vendors was not easy and before making the decision to switch vendors, Management, in detail, outlined the issues which required immediate remedying. Unfortunately, the conditions did not improve over a sixty (60) day period, and as a result it was recommended and determined that bringing in the new contractor had become necessary. Notwithstanding, we part ways on amicable terms and would like to thank them for their years of service to the community.

We are working diligently to enhance the appearance of our community and are confident that you will see positive results over the coming months. Thank you in advance for your understanding in this matter.

Gates to the Greens Pool

Dear Greens Resident,

When utilizing the pool area, you are reminded to close the pool gates behind you. Recently we have found that the pool gates have been left left open both when people are using the pool and when the pool area is vacant. Leaving the pool area gates open at any time opens up the community to all kinds of potential liability not to mention that it makes us more susceptible to a tragic accident such as a young child wandering on to the pool deck and falling into the pool. Effective immediately, the Association will take action against any resident or visitor found to be leaving the pool gates open, including fines, loss of pool usage privileges and referral to outside counsel for further action. ACH Debit for Maintenance Payments Now Available


Dear Greens Resident:

As you know, as of March 1, 2010 Down East Management Associates (DEMA) is our new property management firm.

For those of you who are interested in ACH Debit in order to make your monthly payments to the Association, we recently emailed DEMA's ACH Debit Authorization Form which you will need to complete and return to DEMA so as to be able to participate in the program. If you have not received the form and are interested in the program, please email us at thegreensnewsletter@gmail.com

Additionally, for those of you who have prepaid your March (or future) maintenance to Prime prior to the transition, DEMA will be aware of this. If you recently mailed your March payment to Prime, Prime will forward your payment to DEMA (if this is the case, please let us know so that we may track same with Prime and DEMA).

Management Change/March Maintenance Payments

Dear Residents of The Greens,

As you know, effective March 1, 2010 DOWN EAST MANAGEMENT ASSOCIATES will be replacing Prime as our Property Manager. New payment coupons were mailed out to your official billing address and many residents have already received them. The new DEMA coupons should be the only coupons used on a go forward basis effective immediately. So as to alleviate any confusion, please discard the old (Prime) coupons.

Payments for March should be made using the new coupons or if you have not yet received them please mail your March payments to:

Change In Property Management Firm


Dear Residents,

Please be advised that after a lengthy RFP process and careful consideration, effective March 1, 2010, Down East Management Associates (DEMA) will be taking over Property Management operations for The Greens from Prime.

DEMA is a twenty (20) year old family owned and operated company that specializes in managing associations such as The Greens.

Over the coming weeks leading up to the March 1, 2010 takeover, DEMA will be evaluating the services we are currently receiving and will be working to ensure as smooth a transition as possible.

Please remit your February maintenance and roof loan payments to Prime. We will be issuing new coupon books and account information for future maintenance and roof loan payments in the coming weeks. If you currently utilize direct deposit or automatic withdrawal service please notify your bank. The direct deposit and automatic withdrawal service will continue to be available to you following the management change; additional information regarding these services will be forthcoming.

BOARD OF DIRECTORS:

Bradley Schnur (President)

Bradley Schnur has been a resident of The Greens since 2005. He joined The Greens Board of Directors in February 2006, and has served as its President since June 2006. Bradley is an Attorney who was formerly a Prosecutor in Brooklyn, New York as well as Associate in-house Counsel for an Advertising Agency in New York City. Bradley currently maintains his own law practice and is also the owner of SES Resources, Ltd. a Homeland Security based consulting business serving clients worldwide. Bradley looks forward to continuing to serve the needs of The Greens and oversee pending and upcoming projects such as the insurance claim, painting of the buildings, repair of the roadways, and improvement to the landscaping. Bradley encourages Greens residents to reach out to him with any questions or suggestions regarding the community.


Tim Fox (Vice-President)

Tim Fox has returned to serve on the Board of Directors once again. Born and raised in Miami with a professional career in broadcast television since 1971, Tim is currently the Vice-President of Operations at a Miami based corporation responsible for language dubbing and subtitling. The Greens Board is the second community board that Tim has been a part of as his interest is always to help his community. Being a volunteer and helping homeowners while maintaining a home and work is always gratifying to Tim, especially when the community as a whole recognizes that the efforts of a Board member are not self serving but a benefit to all.


Joe Piechocki (Treasurer)

Joe Piechocki has been a resident of The Greens for ten (10) years and has served on the board for the last four (4) years, as Treasurer. Joe has overseen, with the full board, the rebuilding of the financial solvency of the community after the fire some four years ago, plus the repair and rebuilding of some twenty units due to water intrusion. Joe’s entire professional career has been spent as a Hospital Administrator and he currently serves as Vice-President for Clinical and Support Services at Emerson Hospital in Concord, Massachusetts, just outside Boston. Responsibilities include operational management of all non-nursing functions with a community hospital care system. Joe, along with this Board is currently working to bring the exterior appearance of The Greens up to the levels of other communities within the Boca Country Club, with the next tasks being the development of “request for bid proposals” for painting of all units, repaving of streets (hopefully in concert with another HOA to save costs), exterior lighting standardization, and mulching of all planting beds.


Kathy Coughlin (Secretary)

Kathy Coughlin has lived in this community for the past six (6) years and is entering her fourth year serving on the Board in the role of Secretary. Kathy is the owner of TeamHR, a Human Resources Management and Consulting business. Kathy serves on the Board to contribute to the community and looks forward to supporting the Board’s goals of fiscal responsibility and enforcement of our by-laws.


Joan Faunce (Director)

Joan Faunce has been a resident of The Greens since 2001 and this is the first board she has served on, having been a Director since 2008. Helping the community and the homeowners is gratifying to Joan and she is available should a unit owner have a question or concern. Joan works in Law Enforcement with the Department of Homeland Security / Immigration and Customs Enforcement as an analyst in the Office of Investigations/Asset Forfeiture Group.
